These Terms & Conditions (the “Terms”) govern your access to and use of the Machine Cinema hub at hub.machinecinema.aiand any related pages, features, and services we operate (together, the “Platform”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Who we are
The Platform is operated by Fantastic Day Corporation, a Wyoming corporation doing business as “Machine Cinema” (“Machine Cinema,” “we,” “us,” or “our”). References to “Machine Cinema” as a brand mean this company. Our registered address is 1021 E Lincolnway Suite #6196, Cheyenne, Wyoming 82001, United States.
2. Eligibility & your account
- You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Platform.
- Accounts are created and secured through our authentication provider. You are responsible for keeping your login credentials safe and for all activity under your account.
- You agree to provide accurate information and to keep it current. One person should maintain one account; you may not share, sell, or transfer your account.
3. Membership, perks & benefits
Membership gives you access to community features, films, events, and member perks. Perks are offers made available by third-party partners. They are provided “as is,” may change or end at any time, and are subject to the partner's own terms and pricing. Machine Cinema is not responsible for partner products, discounts, or fulfillment, and makes no guarantee that any perk will remain available.
4. Your content & the license you grant us
You retain ownership of the films, images, text, profile information, and other content you upload or post (“Your Content”). You are responsible for Your Content and confirm you have the rights needed to share it.
By posting Your Content, you grant Machine Cinema a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, encode and technically adapt, publicly display, publicly perform, and distribute Your Content, and to create excerpts, clips, stills, and thumbnails from it, in order to:
- operate, improve, and support the Platform — for example, showing your work in the community feed, on your profile, in the watch feed, and in search and recommendations;
- promote and market Your Content, the Platform, Machine Cinema, and our campaigns — including in showcases, recaps, trailers, and newsletters, and on our marketing and social media channels (such as Instagram, X, YouTube, LinkedIn, and Discord);
- distribute Your Content on the sites, apps, and services we operate now or launch in the future (for example, mobile and TV apps).
When we feature Your Content off-Platform, we will credit you by the name or handle on your profile where reasonably practicable. This license ends when you delete Your Content or your account, except for (i) content other members have already re-shared, (ii) reasonable backup copies, and (iii) promotional and campaign materials created or published while Your Content was live (for example, a recap video or a social media post), which we are not required to withdraw — though we will not create new promotional uses after deletion.
5. Acceptable use
You agree not to:
- post content that is unlawful, infringing, hateful, harassing, deceptive, or that you do not have the right to share;
- impersonate others, spam, scrape, or attempt to disrupt, overload, or gain unauthorized access to the Platform;
- misuse perks, referral links, or promotions, or interfere with other members' use of the Platform.
We may remove content and suspend or ban accounts (by account, email address, or IP address) that violate these Terms or harm the community.
6. Community, events & GenJams
The Platform links to community events (including events managed through third-party event tools) and member-led “GenJams.” Participation is voluntary and may be subject to additional event rules and codes of conduct. Event details, times, and availability are set by organizers and may change.
7. Contests & campaigns
From time to time we run contests, tournaments, challenges, or sponsored campaigns (such as GenJams and the Director's Cup). These have their own rules regarding eligibility, submissions, judging, prizes, and rights, which are published with the campaign and are in addition to these Terms. Where there is a conflict for that campaign, the campaign rules control.
If you submit content to a contest, tournament, challenge, or campaign, the license in Section 4 applies to your submission and also allows us to use it in connection with that campaign — for example, in brackets, replays, showcases, viewing parties, judging, and campaign promotion. Where a campaign is run with a partner or sponsor, we may share your submission and related entry information with that partner for the operation and promotion of the campaign, as described in the campaign rules and our Privacy Policy.
8. Our intellectual property
The Platform, including the Machine Cinema name, logo, and the software, design, and content we provide, is owned by Machine Cinema or its licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the Platform under these Terms. You may not copy, modify, or create derivative works of the Platform except as expressly permitted.
9. Copyright complaints (DMCA)
We respect copyright and expect the same from our members. If you believe content on the Platform infringes your copyright, send a takedown notice under the Digital Millennium Copyright Act (DMCA) to our copyright agent at machinecinemasupport@fantastic.day(subject line “DMCA notice”) or by mail to Copyright Agent, Fantastic Day Corporation d/b/a Machine Cinema, 1021 E Lincolnway Suite #6196, Cheyenne, Wyoming 82001, United States. Your notice must include:
- identification of the copyrighted work you claim is infringed;
- the URL or other location on the Platform of the material you want removed;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
- your physical or electronic signature.
On receiving a valid notice we will remove or disable access to the material and notify the member who posted it. That member may send us a counter-notification meeting the DMCA's requirements; if we receive one, we may restore the material in 10–14 business days unless you notify us that you have filed a court action seeking to restrain the infringement. We terminate the accounts of repeat infringers.
10. Third-party services & links
The Platform relies on and links to third-party services (for authentication, hosting, video, analytics, email, events, and partner offers) and displays content embedded from platforms such as YouTube, Vimeo, X, and Instagram. We are not responsible for third-party services or websites, and your use of them is governed by their own terms and privacy policies.
11. Disclaimers
The Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the fullest extent permitted by law, Machine Cinema and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
13. Indemnification
You agree to indemnify and hold Machine Cinema harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Platform, or your violation of these Terms or the rights of any third party.
14. Suspension & termination
You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Platform or its members. Sections that by their nature should survive termination (including content licenses already granted, disclaimers, limitations of liability, and governing-law terms) will survive.
15. Governing law
These Terms, and any dispute arising out of them or the Platform, are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Subject to Section 16, any dispute that is not resolved by arbitration will be brought exclusively in the state or federal courts located in Laramie County, Wyoming, and both parties consent to personal jurisdiction there.
16. Dispute resolution: arbitration & class-action waiver
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court.
Informal resolution first. If you have a dispute with us, contact us at machinecinemasupport@fantastic.day with a brief written description of the dispute and your account email. You and Machine Cinema agree to try in good faith to resolve the dispute informally for at least 60 days before starting any formal proceeding.
Agreement to arbitrate.If we cannot resolve the dispute informally, you and Machine Cinema agree that any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than by a judge or jury in court. The Federal Arbitration Act governs this section. The arbitration will be decided by a single arbitrator, conducted in English, and may proceed by videoconference or telephone; any in-person hearing will take place in Laramie County, Wyoming, or in the county where you live, at your choice. Arbitration fees will be allocated as the AAA's Consumer Arbitration Rules provide, and we will pay them to the extent those rules require. The arbitrator may award the same remedies on an individual basis that a court could.
Exceptions. Either party may (i) bring an individual claim in small-claims court, or (ii) seek injunctive or other equitable relief in court to protect its intellectual property or to stop unauthorized access to or abuse of the Platform.
No class actions. You and Machine Cinema each agree that disputes may be brought only on an individual basis, and each waive any right to participate in a class action, class-wide arbitration, or other representative proceeding. If this waiver is found unenforceable for a particular claim, that claim — and only that claim — must be brought in court under Section 15, and the rest of this section remains in effect.
30-day opt-out. You may reject this arbitration agreement without penalty by emailing machinecinemasupport@fantastic.day within 30 days of first accepting these Terms, stating your name, your account email, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Platform after changes take effect means you accept the updated Terms.
